1. Agreement
These terms are an agreement between you and Gievs ("Gievs", "we", "us"). They apply when you visit gievs.com, view a sample or client site we host here, send us a project request, or buy a site or hosting from us. By doing any of those things you agree to them. If you are acting for a business, you confirm you have the authority to accept these terms on its behalf. If you do not agree, please do not use the site or our services.
2. What we do
Gievs designs and builds websites, landing pages, sales funnels, GoHighLevel builds, and custom builds with automations, for creators, local businesses, communities and service brands. The details of any project, what is included, what it costs and when it is delivered, are set out in the checkout you complete or agreed in writing between us. If those written terms and these terms conflict, the written terms for that project win.
3. Free samples and preview sites
- When you send us a project request, we may build a free sample site from the details, links, photos and logo you provide and from the business's existing public presence. The sample is a preview so you can see what we would build. Nothing goes live on your own domain, and nothing is owed, until you tell us to proceed.
- Previews are hosted at an address on gievs.com. They are for review: we can change, replace or take them down at any time, and a preview is not a promise that the finished site will be identical.
- We sometimes build a sample for a business before it has asked for one, to show what its site could look like. That kind of sample is a demonstration, is not endorsed by the business, and comes down on request: email hello@gievs.com from a business address and we will remove it promptly.
- A sample stays our property until you buy the site. You may share your preview link to get feedback, but you may not copy the sample, reuse its design or code elsewhere, or present it as your own work.
4. Orders, pricing and payment
- Prices, the plan you choose and what it includes are shown at checkout. The build fee is due when you order. A hosting plan bills monthly, in the currency shown at checkout (US dollars, or Canadian dollars for a Canadian business), until you cancel.
- Payments are processed by Stripe. We do not see or store your full card details. Prices exclude any sales tax, GST or HST that applies, which is added at checkout where required.
- You can cancel a monthly hosting plan at any time by emailing hello@gievs.com. Cancellation takes effect at the end of the period you have paid for; hosting then stops and the site goes offline unless it has been moved elsewhere. We do not refund partial months.
- The build fee pays for work we perform on your site. Once you have approved the sample and the site has gone live, the build fee is not refundable except where the law requires it. If something about the delivered site is not what you ordered, email us within 14 days and we will put it right or agree a fair resolution with you.
- If a payment fails or a plan lapses, we may pause hosting after giving you notice by email, and restore it once the account is settled.
5. Your content and your responsibilities
- You keep ownership of everything you give us: your name, logo, photos, videos, text and any other material ("your content"). You give us a licence to use it to build, host, preview, improve and support your site, and to show the site in our portfolio as described in section 6.
- You confirm that you have the right to use your content, that it does not infringe anyone else's rights, and that it is accurate and lawful. Prices, claims, licences, certifications and testimonials on your site are your responsibility.
- You are responsible for the messages your site receives through its forms, and for handling them, and any personal information in them, lawfully.
- You will not use gievs.com, our forms, or any site we host for anything unlawful, deceptive or harmful, to send spam, to distribute malware, to scrape or overload our services, or to get around limits we put in place.
6. Ownership of the finished site and our portfolio
- When you have paid the build fee, you own the finished site as delivered: the pages, the design as applied to your business, and the content on it. You can move it, change it, or have someone else host it.
- We keep ownership of our own tools, templates, techniques, code libraries and general know-how, and we may reuse them on other projects. Nothing we build for you gives you rights to those.
- We may show the sites we build, including yours, on gievs.com and in our marketing as a screenshot with the business name, unless you tell us in writing that you would rather we did not.
7. Hosting and third-party services
- Hosting we provide runs on infrastructure from LineCrush and Spraggins Designs and their providers. We aim to keep your site available and will tell you about planned maintenance where we can, but we cannot promise uninterrupted service, and we may suspend a site that is used in breach of these terms or that puts the platform or other clients at risk.
- If your site is uploaded to GoHighLevel or another platform you hold an account with, that platform's terms govern your account and the site once it is there.
- If we register or manage a domain name for your site, the registrar's terms apply to it as well, and we will help you move it to your own account on request.
8. No guarantee of results
We build to a high standard, but we do not promise particular results from a site. Leads, sales, rankings and traffic depend on your business, your market and things outside our control. gievs.com and our services are provided "as is" and "as available", and to the fullest extent the law allows we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent the law allows, Gievs, LineCrush, Spraggins Designs and the people who work with us are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from gievs.com or our services. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some places do not allow these limits, so they apply only as far as the law permits.
10. Indemnity
You agree to defend and indemnify Gievs against claims, losses and costs, including reasonable legal fees, arising from your content, your use of a site we built or host, or your breach of these terms.
11. Ending the agreement
You can stop using gievs.com at any time and cancel hosting as described in section 4. We may suspend or end a service if you break these terms, if we are required to by law, or if we stop offering it; in that last case we will give you reasonable notice and help you move your site. Sections 5, 6, 8, 9, 10 and 12 continue after the agreement ends.
12. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. If we have a disagreement, email hello@gievs.com first and we will try to sort it out informally within 60 days. A dispute that cannot be resolved that way will be brought in the state or federal courts located in California, and you agree to their jurisdiction, except that either of us may bring a claim in small claims court where it qualifies. Nothing in this section takes away consumer rights you have under the law where you live.
13. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. Changes apply from the day they are posted, and continuing to use gievs.com or our services after that is acceptance of the new terms. Changes to a project already under way are agreed with you in writing.
